Tradeiceonline.com is a cloud-based, on line, real-time venue to allow anyone to sell, buy or trade arena ice rentals - at anytime, from anywhere. The following describes the terms on which tradeiceonline.com offers you access to our services.

Introduction

By using the services on tradeiceonline.com (also referred to as “Website” below), you are agreeing to the following terms.

Before you may become a member of the Website, you must read and accept all of the terms and conditions in and linked to this User Agreement and the Privacy Policy. We strongly recommend that, as you read this User Agreement, you also access and read the linked information.

This Agreement is effective upon acceptance by new users.

Please report problems and policy violations to us.

Without limiting other remedies, we may limit, suspend, or terminate our service and user accounts, prohibit access to our Website, remove hosted content, and take technical and legal steps to keep users off the Website if we think that they are creating problems, possible legal liabilities, or acting inconsistently with the letter or spirit of our policies. We also reserve the right to cancel accounts that have been inactive for a consecutive period of 12 months. If we decide to cancel the account, we will notify you by email at least 5 business days before doing so.

Fees and Services

Joining tradeiceonline.com, listing ice times and viewing of available rentals are free. We do charge fees for selling ice rentals. All sales are final. In the event that an ice rental is not made available to the buyer at the time specified on their ice rental agreement, a refund will be granted. Please see our Refund Policy.

Our fees are as follows:

For example: a single use ice rental is listed for $250, the buyer pays $300, tradeiceonline.com deducts a fee of $25 from the proceeds and remits the balance of $275 to the seller.

For example: a package ice rental is listed for $300 for each hour of ice. Total package consists of 10 packages of 1 hour each. Total package ice rental is $3,000. The buyer pays $3,000, tradeiceonline.com deducts a fee of $150 from the proceeds and remits the balance of $2,850 to the seller.

Sellers are responsible for paying applicable sales taxes on the proceeds of the ice rental, if any. Therefore, the prices for the ice time listings on the Website are to be tax-included prices. Tradeiceonline.com is only responsible for applicable sales taxes on the fee we collected from the transaction.

Tradeiceonline.com reserves the right to change the fee structure at anytime provided that:

  1. The fees in place at the time of the listing of an ice time shall remain in place until it is sold or re-listed.
  2. The new fee structure will be specified in this User Agreement on the Website.

Payment to tradeiceonline.com

Unless otherwise stated, all fees are quoted in Canadian Dollars for ice times delivered in arenas in Canada, and in US Dollars for ice times delivered in arenas in USA. The applicable currency is displayed throughout the Website. In order to purchase an ice rental, payment must be made and received by tradeiceonline.com.

We accept credit cards and debit cards. We use a PCI Level-1, certified payment processor (Beanstream), which holds the highest industry standards for data protection and network security. Tradeiceonline.com does not store any credit / debit card information on our database.

In order to secure your ice rental, payment must be made using one of the above methods. Once payment is received by tradeiceonline.com, your ice rental agreement is generated and it is emailed to the email on your profile. If payment is not received, the ice rental is deemed to be available for purchase.

Payment to sellers

A cheque/check will be mailed to you on the 1st and 15th of each month, 5 days after your time has been delivered for use by the buyer.

Privacy

We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We use your information only as described in the tradeiceonline.com Privacy Policy. We view protection of users' privacy as a very important business principle. We store and process your information on computers that are protected by physical as well as technological security devices. You can access and modify the information you provide us and choose not to receive certain communications by signing-in to your account. Liability Disclaimer

You will not hold tradeiceonline.com responsible for other users' or links' content, actions or inactions, or ice times they list. Instead, the Website is a venue to allow anyone to sell and buy arena ice rentals. We are not involved in the actual provision or use of the facility and time between buyers and sellers.

The sellers providing ice time or other services on the Website are independent contractors and not agents or employees of tradeiceonline.com. Tradeiceonline,com is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such sellers or for any personal injuries, death, property damage, or other damages or expenses resulting there from. Except as stated in our Refund Policy, Tradeiceonline.com has no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond its direct control, and they have no responsibility for any additional expenses, omissions, delays, substitutions or acts of any government or authority.

In no event shall tradeiceonline.com, and/or its respective sellers be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, your access to, display of or use of this Website or with the delay or inability to access, display or use this Website (including, but not limited to, your reliance upon opinions appearing on this Website; any computer viruses, information, software, linked Websites, and services obtaining through this Website; or otherwise arising out of the access to, display of or use of this Website) whether based on a theory of negligence, contract, tort, strict liability, consumer protection, or otherwise, and even if tradeiceonline.com, and/or its respective sellers, have been advised of the possibility of such damages. Under no event will the liability of tradeiceonline.com and/or its respective sellers exceed the full amount that the user has paid to the Website.
